Sitting within the main Outsourcing, Technology and Commercial team and working as a combined team of specialist IT dispute resolution lawyers and commercial IT lawyers, we have been successful in re-aligning a number of the highest profile IT contracts which regularly feature in the national and computer press.

Our Signal methodology is an invaluable tool for determining strategy for problem IT projects. Signal helps capture and analyse the technical, commercial and legal issues which are key to the decision making process. Whilst termination of a relationship is sometimes the preferred route, we are proud of our track record in taking distressed projects and turning the relationship around. 

Our lawyers work closely with our team of in-house forensic accountants in preparing claims and challenging cross claims.  We are the only law firm to offer such an approach.

The following are a few examples of our clients' projects:

  • Her Majesty's Revenue and Customs in its dispute with EDS in respect of the New Tax Credits IT System. This was a high profile dispute with a substantial settlement involving compensation of £71.25 million paid by EDS to HMRC.
  • United Assurance against Unisys for breach of contract arising out of performance problems with software delivered to the value of £14 million. This included advice on termination and the conduct of the subsequent High Court claim against the US supplier.
  • Department for Work and Pensions in dispute with a US supplier of a high profile IT system under a PFI contract. The dispute team undertook a detailed review of the status of the project, supplier performance and possible remedies. The team then assisted in relation to a substantial renegotiation.
  • A major IT supplier in dispute with a UK retailer with approximately 500 retail outlets. The dispute concerned the development and implementation of an EPOS system. We played a central role in identifying a process for the settlement of disputes and re-baselining of the agreement which subsequently led to user acceptance and roll-out.
