In a tough consumer market a unique brand, and its protection is paramount. Nanjing Automobile fully understands this and therefore invested in the world renowned MG brand, buying it together with other assets from the administrators of MG Rover in 2005. However, within a short period of time another company was claiming rights to the MG name.
We helped Nanjing Automobile to defend this attack, not only by defending the claims made in the Intellectual Property Office, but also by launching highly successful proceedings in the High Court. The defendant was found to infringe the MG trade mark and was stopped from using the MG name. Valuable lessons were also learned about the purchasing of intellectual property assets from administrators and we continue to put that knowledge to good use on Nanjing's behalf.
This case built on previous work Pinsent Masons had done with Nanjing in relation to other automotive brands, where collaborative, rather than antagonistic, approaches were used to save the parties from litigation and the necessary time and cost involved.
Nanjing, now owned by Shanghai Automotive, is still investing in automotive brands, and we continue to work closely with Shanghai Automotive to help them to navigate difficult trade mark and intellectual property waters.
