Harassment at Work: Is Your Organisation Doing Enough? - 22 November 2018
It seems that workplace bullying and harassment cases are rarely out of the news. This half day course explores some of the more complex issues associated with preventing harassment at work and managing complaints. Areas covered include:
• What stops victims from raising complaints and how can these concerns be overcome?
• What Tribunals are looking for from employers in terms of taking all reasonable steps to prevent harassment
• How HR and managers can identify the difference between bullying and appropriate management action e.g. in relation to levels of performance or absence management.

In Other News
Budget Update
Of particular interest for HR in this week’s budget is news about IR35 and the increase in employer NICs.
IR35 - We don’t have the detail yet (there is to be a further consultation), but the government has confirmed that it is going to apply the model adopted already in the public sector in the private sector. So, where an individual contracts through a personal service company, the liability for making the employment status assessment and applying PAYE will no longer rest with the PSC but will shift up the chain to the end user (or the agency/other intermediary, if there is one). A couple of key points to note:-
- the change is scheduled for April 2020, not 2019 as had been suggested in some quarters; - it it will apply to ‘large and medium’ business’ only, which means they won’t be operating on a level playing field; and
- HMRC are apparently not going to be ‘automatically’ targeting contractors who were previously reporting as self-employed but where PAYE now starts being applied.
NICs on Termination payments – it appears that the introduction of the changes to NICs on s.401 payments has been put back to April 2020, most likely because of issues around legislating.
