About Eike

Eike advises large and medium-sized businesses and corporations in the areas of corporate compliance and internal corporate investigations. His practice has a particular focus on the design, implementation, monitoring and assessment of Compliance Management Systems in order to assess compliance risk, prevent and detect compliance violations, and improve existing compliance measures and controls accordingly. In addition, Eike conducts comprehensive compliance risk assessments, special audits on behalf of corporations as well as national and international regulators, and internal investigations, e.g. in the areas of corruption, fraud, and tax. Further, Eike has in-depth experience in the fields of international M&A and corporate restructuring. Eike has published various articles and books and has presented on a number of occasions on compliance related topics. Recently, Eike was a jury panel member on the first compliance management system benchmarking analysis of the German DAX 30 corporations published by Fuchs Briefe in 2017.

Experience

  • Conduct a benchmarking assessment on existing compliance measures and a comprehensive worldwide compliance risk assessment at the core business units and some 30 companies of a world market leader for packaging manufacturing systems engineering, including over 100 top-level and mid-management risk assessment workshops at group locations in more than 15 jurisdictions including Germany, Switzerland, China, USA, India, Thailand, Indonesia, Slovakia, Czech Republic, Netherlands and other, and provide advise regarding the implementation of an internal Compliance function and other compliance measures
  • Conduct a special audit and internal investigations at a mid-sized IT distributor in connection with particular sales and procurement practices following a mandate by the company and its private equity shareholder
  • Conduct a compliance risk assessment including assessment and documentation of risk, processes, policies and controls in a Compliance Management Handbook for a building technology enterprise
  • Leading role in the 360° Review of the Compliance Management Systems of a German-headquartered multinational industry corporation, including reviews in Germany, Austria, Slovakia, Croatia, USA, China, United Arab Emirates and Saudi Arabia, in particular in the fields of policies and controls, Compliance function, risk assessment and process development, internal investigations and sanctions, compliance culture, financial controls, internal and external assurance, risk through third parties (business partners, suppliers), M&A and Joint Ventures
  • Leading role in the teams of Independent Examiners of several Swiss Banks under the 2013/14 FATCA compliance program by the Tax Division of the U.S. Department of Justice to settle the dispute with Swiss Banks on tax evasion by U.S. account holders
  • Leading role in the team of the US counsel to the U.S. Foreign Corrupt Practices Act (FCPA) Compliance Monitor under one of the largest ever FCPA settlements, including reviews in, among other, Germany, Austria, Brazil, United Arab Emirates and Egypt, among other in the fields of M&A, internal audit, procurement, controls of business partners, including interviews with supervisory and board members of the group, key business units and key country group companies, key personal of Legal & Compliance, Procurement, Internal, Audit and other during a four-year monitorship
  • Team member of the FCPA post-settlement counsel to a leading vehicle manufacturer on various corruption related topics including whistle-blower reporting, business partner management, and top management training at corporate headquarter functions and regional companies in Germany (multiple), France, Argentina, UK, Malaysia, and Italy
