Neil specialises exclusively in employment law and leads the Employment & Incentives team in Manchester.

Neil's experience

  • Assisted a financial services sector client with ensuring Right to Work compliance for their 2024 Graduate Scheme intake. This included advice on the Right to Work conditions for Student visa holders and supporting the process of switching to the Skilled Worker visa.

  • Assisted home energy retail business with settlement for sponsored and non-sponsored migrant workers. Ensured compliance with sponsorship requirements up to settlement date, including necessary applications due to role changes. Submitted settlement applications for primary applicants and dependents. Advised on nationality options for children, successfully applied for registration as British nationals.

  • Advised a renewable energy sector client on alternative UK visa categories for young professionals and supported their application to add Graduate Trainee sponsorship to their UKVI sponsor licence.

  • Advised our energy sector client on short-term business travel for three jurisdictions, securing guidance on tax, employment and immigration considerations.

  • Advised Wincanton, a transport group, on a class action involving 74 claimants on alleged infringements of the Swedish Derogation Model and other provisions of the Agency Workers Regulations.  A major aspect being alleged failure to ensure parity between agency workers and employees.

  • Advised a major contractor on over 300 holiday pay claims. Worked with the client to avoid becoming a test case in this area and agree an affordable and workable solution both in respect of back-pay and future calculation of holiday pay. Despite this claim being one of the first multiple holiday pay claims issued it did not result in adverse PR for our client.

  • Acted for SIG in the Court of Appeal in 2018 when a Middle East-based employee argued that he has jurisdiction to make employment claims in the UK. This has been joined with British Council v Jeffrey and is likely to become an important authority on this area.

  • Advised a well known manufacturer about an ex-employee joining a competitor with details of a significant new product launch in which the client had invested heavily. Swiftly secured deeds of undertakings from both the ex-employee and competitor confirming this information would not be used and allowing for the launch of the new product later that year without undue competition from the competitor.

  • Advised Mondelez (formerly Kraft/Cadbury).on HR integration of Cadbury and Kraft, including advice on site closures and workforce-wide changes to terms and conditions of employment against a backdrop of national and international media scrutiny.

  • Advised Muller on the acquisition of Express Dairies. Assisted with the TUPE transfer involving thousands of employees, resulting in post-acquisition harmonisation and re-organisation of the management team.
