With today’s employees arriving at disciplinary hearings and grievance meetings better informed than ever and often armed with AI-generated guidance or online legal resources, the employer’s decisions are being scrutinised more rigorously than ever. This practical workshop is for those wanting to sharpen their practice for this more demanding landscape.

Participants will move beyond the basics to explore what robust decision-making looks like when the stakes are high, and how to reach conclusions that are defensible under close examination. This workshop equips participants with the tools to translate those decisions into outcome letters that are clear, precise and legally sound. Communicating outcomes and reasoning to employees in terms that articulate an employer’s reasoning and accurately reflect the processes followed is critical to demonstrating reasonableness in the face of more pushback, more appeals and more tribunal claims. Participants will review real world scenarios and increase their confidence in:

  • making and documenting their decisions transparently and consistently
  • communicating sanctions clearly, giving adequate reasons and avoiding language that creates vulnerability on appeal or at tribunal
  • addressing complaints and managing expectations in a manner that avoids ambiguity
  • dealing with conflicting arguments, interests and evidence with appropriate balance
