Enforcing your contractual obligations in the UAE: A practical guide to success

This practical guidance session will cover the complex interplay between UAE law, specific contractual obligations and the practice of the UAE Courts and help safeguard against common mistakes triggered by employing common law terms in contracts governed by UAE law.

Led by UAE law expert Faisal Attia, run in collaboration with ACC Middle East and North Africa, we will show you how to better understand the nature and effect of your contractual obligations, helping ensure that those obligations are ultimately upheld by the UAE courts or arbitral tribunals applying UAE law.

More specifically we will:

  • Discuss the basics of contract formation and the consequences of failure to comply with key formalities, requisite authorisations and incorporation of terms by reference before moving onto review specific types of contractual obligations.
  • Analyse the scope of contractual liability, how different conditions can trigger different forms of contractual obligations and how certain contractual clauses would shift burden of proof
  • Consider the effect of third party rights, suspension, termination and the choice of foreign laws and foreign courts in the UAE

You will also be able to ask questions during a Q&A session at the end.
