This session will explore the progress made to date across the EU on implementation of Article 17 of the DSM Copyright Directive and what this means for platform provider liability. 

This is the first in a series of webinars hosted by the Pinsent Masons’ Brand Protection and Creative Rights team, focussing on critical Intellectual Property (IP) challenges and opportunities faced by IP owners.

Germany and the Netherlands stand out from most of the other EU Member States as having implemented the DSM Copyright Directive in full and on time. We will share insights into the approach taken in Germany and the Netherlands to the Directive’s most controversial provision, Article 17, which regulates “content-sharing service providers”. Taking Germany and the Netherlands as the likely pan-European standard, we will also assess what the future liability framework for digital platforms will look like right across the EU.
