The case represents a development from the more usual type of video piracy – interception of cable or satellite transmission – and it is anticipated that similar lawsuits will follow.
The suit alleges that iNYC Wireless intercepted Time Warner Cable's wireless Road Runner service, and then sold it on to residents of London Terrace Towers in New York. The piracy has been going on since May, says the suit, and involved the use of Wi-Fi receivers throughout the building.
According to CNet News.com the cable company has asked the District Court for the Southern District of New York to ban iNYC Wireless from intercepting and re-selling Road Runner. It is also looking for compensation from INYC Wireless, the co-operative running the apartment complex, the superintendent and the complex's managing agent.
