Recent trends and practical tips on Occupation Safety and Health

The Hong Kong Government has for years viewed reform to the Hong Kong’s occupational safety regime, as the solution to reducing industrial accidents.

The Occupational Safety and Occupational Health Legislation (Miscellaneous Amendments) Bill 2022 was passed on 19 April 2023, resulting dramatic changes to the consequences of a person being convicted of OSH offences.

The new regime means penalties for both employers and employees taken a great leap and, together with the reform the Labour Department had also pledged to step up enforcement in pursuing individual liability (including director’s and co-workers’ liability). The most drastic changes would be the introduction of indictment meaning offences can be tried in District or even High Court. Under the new regime consultant engineers, independent checking engineers are no longer “immune” from being prosecuted (as a firm or as individual) of OSH offence, and are therefore exposed to the risk faced by contractors.

The H&S LRoC will provide an overview of the amendments, exploring the impacts of the same and considering whether these changes really reflect the severity and deter offenders.
