Much has been said about the conduct of internal investigations following a regulatory incident but discussion rarely centres on the role of a lawyer. With the conduct of internal investigations increasingly under the spotlight by regulators and law enforcement it is crucial that the correct team are involved and the role of the lawyer is often central to that.

This session will focus on that, with specialists from our white collar crime and civil fraud teams examining why it is important for lawyers to be involved from the outset and when in-house teams might benefit from the engagement of external legal resource. Perennial issues such as the protection of privileged communications will be considered, along with other practical matters such as the common legal liabilities our team of specialists see arising from investigations, including Companies Act accounting responsibilities, tax issues, insurance, data protection, covert monitoring of employee comms, money laundering requirements, liaising with law enforcement/regulators.
