IP Webinar Series: Parallel imports and exhaustion of rights in a post-Brexit world

The third session of the IP webinar series focuses on the impact of Brexit on parallel trade

We explore how the intellectual property exhaustion regimes in the EU27 and UK will operate from 1 January 2021, and discuss best practice for IP rights holders around monitoring the flow of their goods between these markets and also into and out of the UK from the rest of the World. Current proposals place the UK in an unique position with both regional and national exhaustion of rights applicable from 1 January 2021. 

We also answer a number of ancillary, but important, questions in this space including:

  • when goods have been ‘put on the market’;
  • what ‘consent’ actually means;
  • the implications of non-enforcement of IP rights against parallel traders;
  • considerations around product packaging; 
  • the impact on parallel imports licences granted by regulatory authorities both pre- and post-Brexit.
