The Court of Justice of the European Union (CJEU) is expected to hand down its long-awaited judgment in Sky v Skykick (C-371/18) on 29 January 2020. The Advocate General’s Opinion in October of last year sent shockwaves through the trade mark world by suggesting that many thousands of existing trade marks could be potentially vulnerable to be declared partially invalid as contrary to public policy or registered in bad faith. The Opinion caused many businesses to question their existing approach to trade mark protection.
