Emily is an experienced litigator with particular expertise in complex data privacy, media disputes and class action litigation, both in the data privacy and competition spheres.

Emily's experience

  • Defended EasyGo entities Kick Streaming Pty Limited and Medium Rare NV, a streaming platform and a gaming platform respectively, in a defamation claim concerning allegedly defamatory comments made by a streamer during a live stream on online platforms.

  • Made a successful application on behalf of a HNW client, at the conclusion of child proceedings, to restate an interim order as a final media injunction in place until the child is 18 years of age.

  • Led a defamation claim on behalf of an HNW client to a successful conclusion at trial. The claim related to defamatory messages, including allegations of criminality and dishonesty, published via WhatsApp to the client’s extended family.

  • Defended News Group Newspapers in connection with group civil proceedings (in the High Court and arbitration) and cost claims arising out of mobile telephone voicemail interception.

  • Acted for a Nigerian telecoms company in relation to the appeal of an arbitral award made against an acquired subsidiary regarding disputed pre-emption rights under a shareholder’s agreement.

  • Acted successfully for a British utilities provider in relation to its claim for breaches of warranty regarding the design, supply, installation and maintenance of a bespoke SAP billing system.

  • Defended an investment bank in Italian civil and criminal litigation, in which it was alleged that it had entered into complex trades with Parmalat, knowing it to be insolvent, with resulting billion Euro losses.

  • Acted for a leading accountancy firm in a landmark case, in which the claimant insurance company (in liquidation) alleged that our client was negligent in auditing its accounts, with resulting losses of £350 million. A key area in dispute was causation and the recoverability of indirect versus direct losses.
