Our experts are continuing the discussion about the impact of the Economic Crime and Corporate Transparency Act 2023 (“ECCTA”) and corporate criminal liability with two more sessions.

Session Two: ECCTA and the Crime and Policing Act 2026: Now you got ECCTA ‘out of the way’, what about the rest of your compliance programme?

Over the past 12–18 months, many organisations have invested significant time and resource establishing a ‘Reasonable Procedures’ defence under the ECCTA. With those foundations now largely in place, the focus is shifting. What does ECCTA mean in practice for your wider compliance framework, and where should compliance teams be prioritising their efforts next?

Under the Crime and Policing Act 2026 ("CPA"), from 29 June 2026, companies and firms will be criminally liable for any offence committed by a senior manager acting within the actual or apparent scope of their authority.

In this 30-minute session, our compliance, regulatory and fraud specialists will explore the practical implications of ECCTA/CPA for broader compliance programmes, and the key developments shaping the compliance agenda over the next 12 months.

We’ll cover:

  • What Failure to Prevent Fraud means in practice for compliance programmes, how organisations are embedding proportionate, sustainable controls.
  • The senior manager test for primary corporate liability
  • The next wave of compliance priorities
  • Looking ahead: how future ‘failure to prevent’ offences may impact companies compliance programmes and what this means for the resources and tools required to meet the future challenge.
