David specialises in providing risk management and dispute resolution advice to clients operating in the infrastructure and energy sectors. David has acted for developers, main contractors and sub-contractors on a wide range of high profile and technically complex projects and disputes.

David's experience

  • Advising tier 1 contractor on its upstream and downstream positions, including in relation to a dispute with its M&E subcontractor, defending multiple time and money adjudications to enable a positive final account negotiation.

  • Advised a leading UK infrastructure services provider in a dispute concerning alleged failures in their system for accurately recording household subscriptions to a garden waste collection scheme, resulting in claims for lost income from unpaid services in a local authority area.

  • Acting for tier 1 contractor on its project for the design and construction of an energy converter substation, which was in severe delay and had alleged defects. Successfully navigated the final stages of the project, achieving a good result on an amicable basis.

  • Acting for Ernst & Young LLP, as administrators of the ISG Group (in administration), a £2bn turnover construction, engineering and fit-out business, on various legal matters following its administration. Prosecuting ISG’s portfolio of claims via adjudication and litigation to secure funds for creditors.

  • Acting for fit-out contractor, running a series of adjudications to secure a positive final account position against employer.

  • Acting for the three-party main contractor joint venture on the Thames Tideway Project, advising on various matters to ensure effective delivery of the West portion of the project.

  • Seconded to Scottish Power Renewables, advising in relation to its £2.5 billion offshore windfarm project, East Anglia ONE. Providing a real-time project counsel role to ensure the successful delivery of the project during its construction phase.

  • Advising insurer in relation to High Court litigation against one of its registered builders. Despite complex limitation and causation arguments and a potentially impecunious defendant, leading and securing a satisfactory settlement at mediation.

  • Advising developer in relation to a refurbishment project which was completed late and over budget. Following a series of adjudications (which varied from straightforward valuation disputes to complex extension of time claims), negotiating settlement of final account.

  • Advising Amey in relation to High Court litigation (Amey LG Ltd v Cumbria County Council [2016] EWHC 2946 (TCC)) from inception in 2011 to resolution in 2016, including leading the disclosure exercise. After a 40+ day trial, Amey won the case, recovering £5+ million net and 85% of its costs.
