Jan Bessell specialises in Nationally Significant Infrastructure Projects and major development. Her main focus is providing strategic planning advice on the Planning Act 2008 consenting and delivery process as well as other major development consenting processes and environmental matters.

Jan's experience

  • Advising National Highways (formerly Highways England) on its successful application for, and subsequent implementation of, a development consent order (DCO) for one of its largest and most complex infrastructure projects: the A66 Northern Trans-Pennine project (A66 NTP), a critical east-west corridor for freight and business traffic and for tourism in the North of England also identified by the Government as a key pathfinder project to accelerate important infrastructure projects.

  • Advised Southern Water, a statutory undertaker, on a wide range of public law and planning matters for their proposed development of major new water supply infrastructure in Hampshire in order to meet a projected water supply deficit. This includes advising on their legal obligations under an agreement entered into with the Environment Agency under s.20 of the Water Resources Act 1991, and the implications of this for Southern Water and its proposals to develop new water supply infrastructure.

  • Advising One Earth on DCO consenting, environmental assessment and consultation on a proposed solar farm with associated battery storage and infrastructure, located primarily in Nottinghamshire. The project is being developed in partnership between Ørsted and PS Renewables.

  • Advised Sunderland City Council and South Tyneside Council and the joint venture company IAMP LLP on the action area plan and consenting strategy for the delivery of the International Advanced Manufacturing Park.

  • Advising EM DevCo Limited on its case for a locally-led urban development corporation in the East Midlands. The corporation focuses on three development sites: Toton and Chetwynd, Ratcliffe-on-Soar Power Station and East Midlands Airport. This involves liaison with the DLUHC on a framework to ensure the development corporation has appropriate powers to deliver on its proposals.

  • Advised Highways England on the A14 Cambridge to Huntingdon Improvement Scheme DCO, including advice on all aspects of land assembly and compulsory acquisition and subsequently on the implementation of all land use powers post-grant of the DCO. The A14 improvement scheme opened to traffic in 2020.

  • Advised on consenting options and strategy for a mixed use research and community development at the Cambridge. The Wellcome Genome Campus at Hinxton is one of the world’s leading genetic research centres for genomics and biodata research, emanating from the Wellcome Sanger Institute and EMBL - European Bioinformatics Institute.

  • Advised Heathrow Airport on its third runway and airport development project, and on its response to the National Policy Statement consultation.

  • Advised Sunderland City Council and South Tyneside Council and the joint venture company IAMP LLP on the action area plan for the delivery of the International Advanced Manufacturing Park.

  • Advised NuGen on the nationally significant infrastructure project known as Moorside new nuclear generating power project in west Cumbria. Advised in particular on the consenting process and environmental impact assessment and habitats regulations assessment.
