Julian's experience

  • Advised a UK university on the management of complaints and claims for alleged breach of contract and the Consumer Rights Act 2015 arising out of the UCU strikes in 2019/20 and then subsequent move to online teaching following government Covid-19 restrictions. This included reviewing the university's obligations under their T&Cs, the preparation of communications to students, the design of no detriment and compensation procedures and the handling of threats of legal action and subsequent claims.

  • Advised a veterinary services provider on the implementation of government regulations regarding the requirement of face coverings in relevant locations. This included advice on the exemptions and how to manage them as well as support on complaints and claims from individuals who are subject to an exemption and argue that they have been treated less favourably under the Equality Act 2010 when their access to premises has been restricted.

  • Advised LSE on a claim for discrimination and personal injury against the school after Dr Piepenbrock, a lecturer at LSE, left the school on ill health grounds and allegations of sexual harassment were made against him by a post graduate student. The claim was rejected by the High Court in 2018. Dr Piepenbrock took issue with coverage of the High Court case in the Daily Mail and alleged that LSE had conspired to provide false and misleading statements in the article (quoted anonymously). Dr Piepenbrock issued a claim for defamation and related loss and injury. We acted for LSE on all aspects of this case.

  • Advised a UK University on a disciplinary case involving allegations of sexual harassment made by two vulnerable postgraduate male students against a female tutor.

  • Advised a specialist performing arts college on a significant overhaul of its existing student facing policies and procedures to ensure their full compliance with the client's regulatory and legal duties to its students. In particular, we assisted in a full re-write ofthe college's code of conduct, disciplinary procedure and harassment and sexual misconduct policies and its student protection plan. We also provided all key stakeholders with detailed training on the revised policies and procedures and related legal obligations and sector good practice once the revised documents were finalised and published

  • Advised University College London University in a Judicial Review by an Irish student against a decision not to admit her on the grounds that her calculated grades did not meet its offer terms. Her Teacher Assessed Grades (TAGs) were sufficient but the Irish Government (unlike the UK) would not condone TAGs as a final award. The case highlights the legal issues faced by UK Universities following the cancellation of examinations across Europe due to Covid-19 and the significant disruption to admissions in respect of both home and international students.

  • Advised Bath Spa University on the termination of an agreement with UK College of Business and Computing Ltd. The College was to provide for recruitment of students who would register with the University but be taught by the College at its London campus for which the College received payment. The College experienced a number of difficulties which triggered a termination by the University in July 2020. The College argued that the University was stopped from terminating and sought an interim injunction which was granted. We acted for the University in the proceedings and related mediation/negotiations.

  • Advised the University of Gloucestershire on a judicial review application brought by Dr. Almani who is a Saudi national. The Applicant alleges that the University unlawfully discriminated against her on grounds of nationality and that she was initially offered the opportunity to take a PhD in less than 3 years as she was on a second PhD and had less than 3 years available for UKVI purposes. The University did not make such an offer and was successful in resisting the application at permission and was awarded its costs.

  • Advised the LSE in relation to a high profile complaint that its Islamic Society Dinner was unlwafully segregated on the basis of gender.

  • Acted for healthcare insurer in defending four sets of proceedings brought by a former policyholder after claims histories were questioned.
