The Department for Transport has published a new application form and guidance for applications for Stopping Up Orders to close or divert highways to allow development. 

The publications follow the procedural changes introduced by the Growth and Infrastructure Act to allow applications for Orders to be submitted in advance of planning permission being granted.

The Government said that the changes were aimed at creating a "more expeditious" stopping up process and to give applicants for Orders greater choice as to when to submit their application.

The guidance sets out a requirement for applications made in advance of planning permission to be submitted along with a copy of the planning application and any associated highway and site layout plans.

The guidance also advises applicants to have discussions with the planning authority and the highway authority prior to submitting stopping up applications. "This is because once a draft Order has been published, any changes to the area(s) to be stopped up may mean restarting the process thus diminishing the benefit of making an early application," it said.

The new rules come into force on 25 June 2013.
