María Gutiérrez-Bolívar Fernández

María is a Senior Associate in the TMT department of Pinsent Masons Madrid. She is also a member of the Global TDM Evolve Committee of the firm, where she faces cross-border issues related to legal matters affecting Technology, Media and Telecoms products and services. María has been part of the development of new innovative legal products of the firm, such as the global data breach management platform of the law firm.

Data is one of the most profitable assets that companies have, therefore, in the field of data protection, María has helped its clients to develop a bespoke information privacy management system, through a general data protection compliance program. Which include the creation of the companies’ internal privacy organisation, drafting of the applicable governance mechanisms, carrying out risk analysis and privacy impact assessments, drafting data protection agreements and clauses, and giving trainings.

Additionally, she has advised on day-to-day issues related to international transfers, outsourcing technology and privacy contracts, commercial communications and security breaches.

María has participated in multijurisdictional projects with teams from different areas of specialisation generating efficient collaborative strategies. These projects have involved the development of technological products, such as B2B and B2C platforms, where she has advised on e-procurement and information services, intellectual property, advertising, cybersecurity and data protection.

In telecommunications matters, María has advised companies in the sector in administrative and contentious-administrative proceedings before regulatory authorities and courts and tribunals of the contentious-administrative jurisdiction.

She has also participated in judicial proceedings related to trademarks and industrial designs.
